"מצות הפדייה קודמת למצות עריפה"
The Mishnah states: if a person has a first-born donkey but he does not want to be פודה his first-born donkey, he must decapitate it (עורפו). The Mishnah then continues and says, "מצות הפדייה קודמת למצות עריפה". However, the mitzvah of redeeming the donkey does take precedence over decapitating it. As the pasuk says, "אם לא תפדה וערפתו".
The [בכורים פי"ב,א] רמב"ם says: it is a מצות עשה to be פודה a פטר חמור. If one prefers not to be פודה it, it is a מצות עשה to decapitate it. He then quotes our mishnah and the words, מצות הפדייה קודמת למצות עריפה. The רמב"ם is clearly learning that while פדייה takes precedence over עריפה, they are both considered מצות. The [שם] ראב"ד argues strongly. He says, although our Mishnah says פדייה is קודמת to מצות עריפה, it doesn’t mean עריפה is an actual מצוה. On the contrary, it is an עבירה! It is a sin to the decapitation and the owner of the פטר חמור is considered a מזיק because he is causing the כהן a loss by not redeeming it with a שה.
The [שם] כסף משנה defends the רמב"ם and says that the רמב"ם is following פשוט פשט in the Mishnah which states clearly that מצות פדייה קודמת למצות עריפה, and if עריפה was an עבירה, the תנא would certainly not call it מצות עריפה. The ראב"ד says, once the תנא said מצות פדייה he also used the similar terminology of מצותעריפה but it is not to be taken literally.
The [עה"ת פרשת בא ד"ה ואם לא תפדה] חת"ם סופר wonders about the מצות עריפה. Why does the תורה even give the option of עריפה? It seems very selfish and a bad מידה of עין רע - as if to say, “If I can’t keep this פטר חמור then the כהן can’t gain either and I won’t give him a שה but I will rather do an עריפה.” Why should he be able to do this? The חת"ם סופר explains that when Klal Yisroel left מצרים we experienced 3 things. 1) גאולתינו ופדות נפשינו. So, for our גוף we are פודה בכורי אדם. 2) On the גאולת נפשינו from the טומאה, we are מקריב the בכורים of our בהמות, which is נפש בהמה תחת נפש אדם. 3) הריגת בכורי מצרים, for that, since the מצריים are compared to חמורים, we (should) do the עריפה. The reason they are decapitated specifically, without the option of redemption is to underscore that the בכורי מצרים were killed. However, since the חמורים assisted כלל ישראל by the ביזת הים, Hashem took pity on them and gave us the option of redemption with a שה. However, even so, the original עיקר and שורש of the reason remains and one may do עריפה which will be a remembrance of the הריגת בכורי מצרים.
